Criminal Harassment
Our client was charged with criminal harassment in relation to another individual over a period of a couple years. Their relationship when back much further than that, and so Crown made pre-trial applications to allow them to call evidence from outside the dates our client was charged. We argued against this similar fact evidence, and the judge agreed that it was too speculative and contested to be admissible in the trial. Directly because of this ruling, Crown offered a conditional discharge for our client.
