Aggravated assault is an indictable offence that carries a maximum sentence of 14 years in prison. This type of assault usually involves very significant or life-threatening injuries.

Depending on the injuries sustained, this type of assault can be treated as a summary conviction or an indictable offence. Assault with a weapon is where a threat or act of violence is made with a gun, knife, or another item, i.e., a cell phone. If treated as a summary offence, it can carry a maximum sentence of 18 months in jail. If your case is preceded by indictment, you can be facing a maximum sentence of up to 10 years in prison.

Sexual Assault

Sexual assault can be prosecuted as a summary conviction or an indictable offence. Consequently, it carries a maximum sentence of 18 months in jail or up to 10 years in prison, respectively. Sexual assault is the combination of the threat or act of assault in a non-consensual sexual contact.

In the last number of years, the Supreme Court of Canada has released several key decisions that have changed the law surrounding consent and potential defences to sexual assault.

Domestic assault consists of a variety of acts, from physical abuse to sexual abuse to coercion to uttering threats. Criminal harassment also falls into this category. The Criminal Code of Canada does not have a single law that dictates the penalty for domestic assault, but the Criminal Code does prescribe harsher punishments for crimes committed against an intimate partner.
