R. v. C.K. – April 2023

Sexual Assault

Our client was charged with inappropriately touching a teenager who he lived with, but was not related to. At trial, our cross-examination of the complaint established that even from the complainant’s perspective, there was no sexual touching until a very brief encounter near the end, which was contrary to her original statement to the police. Our client testified and ultimately the judge agreed with us that while our client may have made contact with the complainant, that when he touched her he did not have any intention to sexually assaulting her.
