R. v. T.B. – November 2020

Police arrested our client on a mental health warrant and seized several items including a firearm. Crown counsel chose not to proceed with charges, but police refused to return the items on public safety grounds. After attempting to negotiate with police, we brough an Applicant to return the items to our client. After a hearing, the judge ordered the items to be returned.
