R. v. P.R. – June 2022

Robbery

Our client was charged with robbery and alleged to have taken a speaker and a gold chain from the complainant. We examined the evidence and found that the picture of the speaker box the complainant sent to police and the speaker recovered by the police had different serial numbers. In cross-examination we got the complainant to testify that he was sure the picture of the box corresponded to the speaker that was taken from him. That along with weakening his evidence about how long he observed the unknown male led the judge to conclude that the Crown had not proven identification.
