R. v. D.H. – January 2024

Obstructing a Police Officer

Our client was alleged to have disobeyed orders from a police officer after a traffic accident. Our lawyers gathered information form his treating psychiatrist to establish his past history of trauma may have made his actions simply reactionary and therefore involuntary. Crown rebuffed our attempts to resolve the matter but ultimately dropped the charges after we filed Charter notice outlining that our client’s right to be tried within a reasonable time was breached.

Result: Charges Dropped
