R. v. J.C. – April 2024
Impaired Driving Causing Bodily Harm
Our client was charged with impaired driving causing bodily harm to 2 individuals when a vehicle struck the tractor he was operating, causing serious injuries to the occupants of the vehicle. Crown Counsel was seeking a jail term and our lawyers argued for a Conditional Sentence Order to allow our client to serve his sentence in the community. Our lawyers were able to point to our client’s personal background circumstances, including his efforts at sobriety since the incident date and strong prospects of rehabilitation through reference letters from his family and peers. The judge at sentencing granted a Conditional Sentence Order despite the sentencing range for this offence usually requiring a jail term.
