Impaired Driving Case Study: Invalid Police Demands and Evidentiary Issues

Our client was arrested on an allegation of impaired driving, was released by police and then arrested on a second allegation of impaired driving within a two-hour period. We reviewed the evidence and determined that police made an invalid breath demand on the first allegation and raised evidentiary issues with the breach samples on the second allegation. Crown agreed to resolve both matters without a criminal record or a driving prohibition.
