Assault with a Weapon
Our client was charged with assault with a weapon in allegations that he had attacked his wife with a broom and threatened to kill her. We were prepared to proceed to trial when the complainant provided additional statements and videos right before the scheduled trial dates. Those trial dates were adjourned. We reviewed this new evidence and found numerous inconsistencies with her earlier statements, including evidence that one assault she described would have happened while our client was at work. We provided lengthy submissions to Crown counsel including revealing that our client had video evidence that he was working at the time of this new allegation. Crown counsel decided to drop the charges.
