Our client was charged with Assault and Assault Causing Bodily Harm after his ex alleged that he broke her arm.  There was no issue that her arm was broken but our client was consistent that he did not break it.  The Crown would not drop the charges so the matter proceeded to trial.  In cross examination we got the complainant to admit several significant factors showing she was the aggressor in the incident.  The Judge ultimately found that the evidence was insufficient to convict our client and the charges were dismissed.  Our client received no criminal record.
