Impaired Driving Causing Bodily Harm

Our client was looking at significant jail sentence when he was alleged to be driving while impaired and causing a head-on collision on the highway causing significant injuries to the complainant. At a preliminary inquiry we questioned the police officer and gained valuable evidence that established that the officer did not provide our client with his Charter rights at the roadside and preformed an illegal search in our client’s vehicle. We also established evidence from another driver that he observed our client’s vehicle lost a wheel prior to it swerving into the oncoming lane. This evidence severely weakened the Crown’s case and so they agreed to resolve the file with a plea to the Motor Vehicle Act with no driving prohibition.

Result: No Jail Time, No Criminal Record and No Driving Prohibition
