Impaired Driving

Our client was charged with impaired driving when he struck a tree, left the scene and drove the vehicle home. Police attended his residence and found the damaged vehicle in the driveway. They arrested our client and transported him to the police detachment, where he refused to provide breath samples. Our lawyers highlighted weaknesses in the Crown’s case by raising potential Charter breaches related to the authority of the officers to arrest our client. Additionally, we were able to provide Crown Counsel with personal background information about our client, including his status in Canada as a Permanent Resident and the fact that he could be deported if convicted of impaired driving. We negotiated a resolution to a plea under the Motor Vehicle Act, and proposed conditions that would allow our client to drive to and from work.

Result: No Criminal Record and No Driving Prohibition
