R. v. D.D. – September 2022
Excessive Speeding
Our client was charged with the traffic violation of excessive speeding. We requested evidence from the officer involved by way of two separate letters and argued at two traffic court hearings that the officer had failed in his duty to provide full disclosure. Ultimately, we filed Charter notice that argued client’s right to have his trial within a reasonable period of time had been breached. We filed our argument in court and served it upon Crown counsel. Upon reviewing our arguments Crown counsel dismissed the charges without a hearing.
