R. v. D.D. – March 2019
Drug Trafficking Case Study: Problematic Identification Evidence Leads to Acquittal
Our client was charged with trafficking in fentanyl and alleged to have sold to an undercover officer during a dial-a-dope operation. Identification evidence consisted of the undercover officer’s description of the accused and a photograph taken several months after the allegation. The officer testified that the individual who sold the drugs had a tattoo on his left arm, which led to a dramatic in court reveal of no tattoo on our client and an immediate acquittal.
