R. v. L.S. – February 2023
Impaired Driving by Alcohol
Our client was charged with impaired driving and dangerous operation of a motor vehicle when he struck multiple vehicles while operating his vehicle under the influence of alcohol. The circumstances included the fact that our client had a family member in the vehicle call 911 while he was driving, which captured the harrowing drive on police audio recordings. We provided lengthy submission to Crown counsel to show our client’s recent mental health struggles which had started due to the unexpected death of his brother. We ultimately argued that our client was suicidal on the night of the incident, but had since made significant strides to address his mental health and alcohol issues. Crown agreed to a plea to a non-criminal offence under the Motor Vehicle Act.
