R. v. C.C. – September 2021
Impaired Driving Causing Bodily Harm
Our client was alleged to be under the influence of alcohol when his vehicle missed a turn and collided with a barrier, rolling over multiple times before coming to rest. One passenger in the vehicle suffered a broken collarbone and a punctured lung. Crown Counsel’s initial sentencing position included jail time. We argued that police breached our client’s rights by taking a blood sample without allowing him to speak to a lawyer, raised significant sympathetic factors about our client and raised witness issues prior to the trial. Our client plead guilty and received a house arrest.
