Aggravated Assault and Child Pornography

Our client was charged with a serious assault and possession of child pornography. We argued to Crown Counsel that there was strong evidence of drug psychosis at the time of the assault which would make our client’s actions involuntary. We also argued that police acted outside their lawful authority when they remained in our client’s home after attending for a wellness check and ultimately seized a computer without a warrant. Our client would have faced a significant jail sentence but we negotiated a short house-arrest sentence.

Result: No Jail Time
