Our client was stopped at the border and found with a loaded handgun on him. He was charged with Possession of the loaded gun, Lying to a Border Services Officer and Smuggling. Our instructions were that our client could not have a criminal record so the case was set for trial. We adjourned the first trial and scheduled a second trial date. We served the Crown with formal notice of a Charter application and insisted they call a witness who had been fired from Border Services. Shortly before the second trial date the Crown dropped all the charges against our client.
RESULT: no trial, no criminal record
