Our client was involved in a serious motor vehicle accident and his car was smashed, head first into a barricade. After fleeing on foot, he was stopped by police and a blood alcohol test revealed that he was double the legal limit. Our client, a professional truck driver, was facing a criminal conviction and driving prohibition. We suggested to Crown that due to Charter issues arising from the investigation, a plea under the Motor Vehicle Act was more appropriate. The Crown agreed and our client plead guilty under Section 144(1)(a) of the Motor Vehicle Act, obtained no criminal record and was able to continue driving for the purposes of his employment.
RESULT: no criminal record, driving curfew for 4 months
