Successful Appeal

Charge:
Possession of Cocaine for Trafficking
Potential Sentence:
Lengthy Jail
Result:
Conviction at Trial, Overturned on Appeal
Description:

During the course of the trial in Surrey Provincial Court, we argued that our client's Charter rights against an unreasonable search had been violated.  We argued the evidence found in the car should be excluded.  The trial judge disagreed and convicted our client.  We appealed to the B.C. Court of Appeal, which overturned the conviction and dismissed the charges against our client.  See http://www.courts.gov.bc.ca/Jdb-txt/CA/08/00/2008BCCA0089.htm
