R. v. U.V. (June 10/11)

Charge:
90 day Immediate Roadside Suspension
Potential Sentence:
90 day driving suspension, $500 fine, Vehicle Impounded, Required Responsible Driver's Course, Interlock device installed in car for 1 year
Result:
Overturned on Appeal
Description:

Our client was stopped by police and blew "fail" on the Approved Screening Device (roadside breathalyzer).  He was immediately prohibited from driving for 90 days and his vehicle impounded.  We reviewed the paperwork sent by the police to the Superintendent of Motor Vehicles and noticed a significant error.  On appeal we were successful in not only having the driving prohibition revoked, but also in having the Superintendent of Motor Vehicles pay the vehicle towing and impoundment expenses.
