R. v. P.W. (June 27, 2011)

Charge:
Impaired Driving, Driving Over .08
Potential Sentence:
Criminal Record, high fine, 1 year driving prohibition, Responsible Driver's Course, Interlock device
Result:
Criminal charges dropped, plead to Motor Vehicle Act offence, $1000 fine
Description:

Our client was pulled over by the police for bad driving.  He blew a "fail" on the roadside breathalyzer and over double the legal limit back at the police station.  We set the matter for trial and demanded full disclosure of all evidence.  Upon receipt of the police cell block video, our analysis revealed a major procedural mistake by the police.  We showed this to the Prosecutor who agreed to conclude the file with a Motor Vehicle Act fine.
