Sicotte and Henry

Our client was found in the driver's seat of his vehicle which was in a ditch off the road.  He was surrounded by empty beer cans and severly intoxicated.  We discovered that the arresting officer had a disciplinary record of his own and we argued on our client's behalf that there was insufficient proof he was in "care and control" of the vehicle.  Based on these factors, and our client's good conduct since, the Crown agreed to drop the criminal charges and allow our client to plead to Driving Without Due Care under the Motor Vehicle Act.
