Cleared of Impaired Driving
Our client's driving was captured on video by the Surrey police helicopter. She was stopped, arrested and later provided breath samples over the legal limit. During cross examination of the arresting police officer evidence was elicited that he did not properly assist her in contacting the lawyer of her choice. We then successfully argued that the evidence of her excessive breath samples should be excluded from evidence. Finally, we successfully argued that her driving difficulties were not attributable to alcohol impairment. All the charges were dismissed.
